Terms of service
Please read these Terms of Service ("Terms") carefully before using the Nod mobile application or website (together, the "Service"). By creating an account, logging in, or otherwise using Nod, you agree to these Terms and our Privacy Policy, which is incorporated here by reference. If you do not agree, do not use the Service.
1. What Nod is — and is not
Nod is a proximity introduction tool. It lets people nearby share what they are open to and start a conversation when both sides say yes. Nod uses Bluetooth Low Energy and device location to match active Nods in your area. The Service is operated by Nod ("we", "us", "our").
Nod is not: a dating agency, matchmaker, employer, chaperone, background-check service, emergency service, or guarantor of any user's identity, intentions, conduct, or safety. We do not verify whether users are who they say they are. We do not screen criminal histories or conduct suitability assessments. Using Nod to meet people carries the same real-world risks as meeting strangers through any other means. Read our Safety Guidelines before meeting anyone you have connected with through Nod.
2. Eligibility and age
You must be at least 17 years old to use Nod. By using the Service, you confirm that you meet this requirement and that the date of birth you provide is accurate. We may terminate accounts of users who misrepresent their age. Nod is not intended for children under 17.
3. Your account
- You are responsible for maintaining the security of your account credentials.
- You may not share your account with others or create accounts on behalf of others without permission.
- You must provide accurate information (including your name, email, and date of birth) when creating an account.
- Notify us immediately at support@gonod.app if you suspect unauthorised access to your account.
4. Licence to use the Service
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to install and use the Nod app for your personal, non-commercial use. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, except as permitted by applicable law.
5. Acceptable use
You agree not to:
- Use Nod for any unlawful purpose
- Harass, intimidate, threaten, stalk, or abuse other users — online or after meeting in person
- Post hate speech, sexually explicit content involving minors, or content that promotes violence or illegal activity
- Impersonate any person or entity, or misrepresent your affiliation, identity, appearance, age, or intentions
- Send spam, unsolicited messages, or automated messages
- Use Nod to facilitate crimes, fraud, scams, trafficking, exploitation, or any form of commercial sex work
- Pressure, coerce, or manipulate another user to meet in private, share sensitive personal information, or send money or gifts
- Record, photograph, or share another user's private communications, likeness, or location without their consent and where applicable law prohibits it
- Interfere with or disrupt the Service or its servers
- Attempt to reverse-engineer, decompile, or extract source code (except as permitted by law)
- Use Nod to collect or scrape data about other users without their consent
- Post content that is illegal, offensive, defamatory, or infringes intellectual property or privacy rights
- Circumvent safety features (including reporting, blocking, or content filters)
- Contact someone who has blocked you, or continue unwanted contact after they have declined
Violations may result in immediate account suspension or permanent termination, and may be reported to law enforcement.
6. User content, safety, and moderation
Nod includes user-generated content ("UGC"), including Nod text, profile names, profile photos, and chat messages. This section describes your rights and our safety practices.
6.1 Your content
You retain ownership of content you create. By using Nod, you grant us a limited, non-exclusive, royalty-free, worldwide licence to host, store, reproduce, display, and transmit your content solely as necessary to operate the Service. We do not claim ownership of your content.
You are solely responsible for the content you post and send. We are not responsible for content posted by other users.
6.2 Automated filtering
Nod uses automated tools to help detect and block profanity and other objectionable content in Nod text, profile names, and messages before or when it is posted. Automated filtering is not perfect and does not guarantee that all harmful content will be prevented.
6.3 Zero tolerance
Nod has zero tolerance for objectionable content and abusive users. We may remove content and suspend or permanently terminate accounts at our discretion, with or without notice.
6.4 Reporting
You can report another user or their content in the app:
- Nearby — swipe left on a Nod, then tap Report
- Chat — open a conversation, then use Report from the chat menu
- Profile — open a person's profile, then use Report
Reports are reviewed within 24 hours. For urgent safety concerns email support@gonod.app with the subject "Safety report". For immediate danger, contact your local emergency services — Nod is not an emergency service.
6.5 Blocking and hiding
- Report — flags a user or content for our review. You may choose to block the person at the same time.
- Block — stops interaction, removes the person from your feed, and notifies us so we can review the account. Blocking is available from Chat and Profile, and optionally when submitting a Report.
- Hide — removes someone from your Nearby list only. Hide does not notify us or affect other users' experience.
Blocking or hiding someone removes them from your experience immediately. Removing a user from Nod for everyone requires our moderation action after review.
6.6 Our response to reports
We review reports within 24 hours. We may remove content, issue warnings, suspend accounts, or permanently ban users who violate these Terms. We may retain report data for safety, security, and legal purposes as described in our Privacy Policy.
7. Interactions with other users — virtual and in person
This section is important. Please read it carefully.
7.1 Nature of the service
Nod provides a platform to make introductions. All decisions about whether to interact with another user — virtually or in person — are yours alone. Nod does not vet, screen, endorse, or guarantee any user.
7.2 No verification or background checks
Nod does not verify users' identities, ages (beyond the date of birth you self-report), physical descriptions, professions, or any other profile claims. Nod does not conduct criminal record checks, sex-offender registry checks, or any other background screening on users. Profile information may be inaccurate, incomplete, or false. You accept full responsibility for verifying the identity and intentions of anyone you interact with through Nod.
7.3 Virtual interactions
When you exchange Nods, send or receive connection requests, or chat with other users, you do so at your own discretion and risk. Nod does not monitor conversations in real time and is not responsible for what users say to each other. You may receive content that is offensive, misleading, or harmful despite our filters. Use the block and report tools if needed.
7.4 In-person meetings
If you choose to meet someone in person after connecting on Nod, you do so entirely at your own risk. Nod is not present at, does not supervise, and accepts no responsibility for any in-person meeting arranged through the Service. Risks of meeting strangers include but are not limited to: personal injury, assault, sexual assault, robbery, theft, fraud, property damage, emotional harm, transmission of disease, and other unforeseen events.
We strongly recommend: meeting in a busy public place, telling a trusted person where you are going and who you are meeting, arranging your own transport, avoiding sharing your home address or accommodation details before you trust the person, staying sober enough to make clear decisions, and leaving at any time if you feel uncomfortable. See our Safety Guidelines for more detail.
Following our safety recommendations does not create any duty of care, obligation, or liability on the part of Nod, and does not reduce your personal responsibility for the choices you make.
7.5 Assumption of risk
By using Nod, you expressly acknowledge and accept that:
- Interacting with strangers online and meeting them in person carries inherent risks;
- Nod cannot and does not guarantee the accuracy of user profiles or the safety of any meeting;
- You are solely responsible for your interactions with, and decisions about, other users;
- Nod is not liable for the conduct, online or offline, of any user of the Service.
7.6 Release of claims
To the fullest extent permitted by applicable law, you release and discharge Nod and its officers, employees, agents, and successors from any and all claims, demands, losses, damages, and liabilities of every kind arising out of or in connection with:
- The conduct, content, or actions of any other user of the Service, whether online or in person;
- Any meeting, encounter, or interaction you arrange through the Service;
- Any harm — including personal injury, assault, sexual assault, theft, fraud, emotional distress, property damage, health consequences, or financial loss — caused by another user.
Nothing in this release limits liability that cannot be excluded under applicable mandatory law (for example, liability for death or personal injury caused by our own proven negligence, or for fraudulent misrepresentation by us).
8. Indemnification
You agree to defend, indemnify, and hold harmless Nod and its officers, employees, agents, and successors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Content you post, send, or otherwise submit through the Service;
- Your use or misuse of the Service;
- Your interactions with other users, including any meeting you arrange;
- Your violation of these Terms;
- Your violation of any law or the rights of a third party;
- Any claim that you provided false information (for example, age or identity) to Nod or to another user.
9. Privacy
Your use of Nod is subject to our Privacy Policy, which explains what information we collect, how we use it, and the choices you have. Location is used only for proximity matching and is not shown to other users on a map.
10. Service availability and changes
We will endeavour to keep Nod available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable for any loss or inconvenience caused by downtime or changes to the Service.
11. Intellectual property
All intellectual property in the Nod app, website, and brand (including the logo, wordmark, and design) is owned by Nod or its licensors. Nothing in these Terms grants you rights to use our intellectual property without prior written consent.
12. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to:
- Merchantability, fitness for a particular purpose, or non-infringement;
- That the Service will be uninterrupted, error-free, secure, or free from viruses or harmful components;
- That any user is who they say they are, is suitable to meet, or will behave safely;
- That any meeting arranged through Nod will be safe or free from harm;
- That user content is accurate, complete, or inoffensive, despite our moderation tools.
Some jurisdictions do not allow the exclusion of implied warranties. In such jurisdictions, the above exclusions apply only to the maximum extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by applicable law:
- Nod shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or opportunity, arising out of or in connection with the Service or any user interaction — whether online or in person — even if we have been advised of the possibility of such damages;
- Nod's total aggregate liability to you for any claim arising from or related to these Terms or the Service shall not exceed the greater of: (a) the total amounts you have paid to Nod in the twelve (12) months preceding the claim, or (b) fifty pounds sterling (£50);
- Nod is not liable for any conduct, content, or actions of other users, whether virtual or in person, including but not limited to harassment, fraud, assault, theft, defamation, or any other harm caused by a third party.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our own negligence, for fraud or fraudulent misrepresentation by us, or for any other liability that cannot be excluded or limited under mandatory applicable law (including consumer rights that apply in your jurisdiction).
14. Termination
We may suspend or terminate your account at any time if we believe you have violated these Terms or pose a risk to other users or the Service. You may delete your account at any time from within the app: Profile → Security → Delete Account. When your account is deleted, your profile and related content are removed as described in our Privacy Policy. Abuse reports may be retained for safety and legal purposes.
Sections 7 (Interactions), 8 (Indemnification), 12 (Disclaimer), 13 (Limitation of liability), and 15 (Disputes) survive termination of your account or these Terms.
15. Dispute resolution and governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory consumer protection laws in your country of residence give you the right to bring proceedings in your local courts.
Before initiating formal legal proceedings, we encourage you to contact us at support@gonod.app to try to resolve the issue informally first.
16. Third-party platforms
If you downloaded Nod from the Apple App Store or Google Play, you must also comply with the applicable store's terms of service. Apple and Google are not parties to these Terms, are not responsible for the Service, and have no obligation to provide maintenance or support for the app.
17. Changes to these Terms
We may update these Terms as the product evolves. We will update the "Last updated" date on this page and notify you of material changes via the app or email where appropriate. Continued use of Nod after changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using Nod and delete your account.
